Galette v. Winthrop Univ. Hosp'l

Negligence in perforating the bowel during the performance of a laparoscopic salpingectomy and subsequent failure to timely diagnose the perforation, resulting in septic shock, requirement for a colostomy, gangrene of the lower extremities leading to bilateral below the knee amputations, and vestibulocochlear nerve damage causing severe permanent hearing loss.

Verdict or Settlement: $18,100,000.00

Negligence during Monitored Anesthetic Care while this 19 year old was undergoing an endoscopy for abdominal pain. After the administration of Propofol and Alfentanil, the patient became bradycardic. The anesthesiologist failed to advise the surgeon for 9 minutes that the patient was bradycardic and to abort the procedure. The anesthesiologist waited an additional 2 minutes before calling a code blue and the patient was not intubated until 16 minutes after bradycardia had begun. When the code team arrived, no pulse was obtainable. The patient was resuscitated, but had suffered profound brain and neurological injuries.

Failure to promptly diagnose and treat a kidney stone that did not pass and resulted in infection, sepsis and ultimately septic shock leading to gangrene of the extremities requiring amputation of both legs below the knees and both hands.

Failure to recognize fetal distress during labor and delivery and failure to timely perform a cesarean section, resulting in hypoxic, ischemic neurological injury.

Elderly lady struck by truck while crossing the street, resulting in crushed leg injuries. Driver claimed he had the right of way, but reconstruction expert and pretrial evidence showed that the plaintiff was without any fault.

Products Liability

Martorana v. Mack Truck
Verdict or Settlement: $3,000,000.00

Plaintiff/decedent was involved in a one vehicle accident on the New York State Thruway while driving a fuel oil truck. His vehicle burst into flames and he died from severe injuries. 

Nursing Negligence

Shaikh, an infant, v. Charles, et al
Verdict or Settlement: $7,943,181.82

A nurse-midwife failed to contact the Obstetrician-Gynecologist M.D. when the fetus began to exhibit signs of fetal distress. Once contacted, the defendant OB-GYN also delayed treatment. Appropriate treatment was for an emergency c-section. By the time a c-section was performed, the child suffered severe neurological injury including spastic cerebral palsy.

The two decedents were passengers in a car that was struck violently in the rear causing pain and suffering and the death of both young men.
